General Conditions - Tropical Cruises – Private Tours and Fishing Trips
(THIS DOCUMENT DESCRIBES THE GENERAL CONDITIONS FOR RESERVATIONS AND PROVIDED SERVICES)

Before making a reservation, please verify the availability of the intended tour or trip with Tropical Cruises. For confirmation of the reservation, a deposit of 50% of the total amount of the tour or trip should be made with our authorized agents or at our bank account (to be indicated). The remaining 50% of the total amount must be paid to our representatives in the beginning of the tour or trip, before boarding.

The contractor/customer must agree with the following general conditions at the moment of the confirmation of the reservation and/or the payment of services:

The confirmation deposit will not be refunded if the tour or trip is cancelled by the contractor/customer.

The confirmation deposit will be fully refunded if the tour or trip is canceled by Tropical Cruises, due to bad weather and/or technical reasons. Tropical Cruises and/or the captain of the vessel are the only agents able to validate the weather conditions for cancellation (we always have in mind the safety of our customer and crew). Another option for cancellation due to bad weather or technical conditions is the reschedule of the trip; in this case, Tropical Cruises will confirm the availability of the same program and vessel for a new date.

The departure of boats to open sea will depend of weather and maritime conditions. Those conditions will be evaluated by the captain responsible for the boat at the moment of departure from the pier.

Maintenance and conduction of boats and vehicles are responsibility of the boats/vehicles owners, captains, and drivers, as established in Brazilian legislation. All boats used by Tropical Cruises have the obligatory DPEM insurance required by the Brazilian navy. Our customers should be aware that this is a basic insurance and is the only available in case of accidents. Additional insurance coverage is recommended and it is NOT included in our service/charter.

Tropical Cruises responsibilities are related to the commercialization of the tours and trips, as well as the organization of the events and itineraries

Customer Responsibilities

Tropical Cruises has the objective of providing the safest and most satisfactory tours and trips. In order to avoid accidents and make your tour or trip a real pleasure from the beginning to the end, customers need to respect and observe some basic rules of behavior and safety. We count on you!

1- Respect the maximum capacity of the boat and/or vehicle.
2- Obey the orders of the boat crew and Tropical Cruises at all times.
3- Passengers with less than 18 years must be escorted by their parents or other responsible agents.
4- Participants of the group should be aware about the individual responsibility related to accidents and problems that may happen in case of dangerous, negligent ,or imprudent behavior.
5- Customer are fully liable for accidents and damages, removing any responsibility from the conductors, captains, crews, owners of vehicles (boats, cars, vans, buses), and Tropical Cruises.
6- Customers should reimburse the boat/vehicle owners in case of any damage due to their own actions to the boat, vehicles, accessories, fishing and snorkeling equipments, or any other material associated to the tour or trip.
7- Customers assume total responsibility for the conduct of all passengers during the total time of the event.
8- The use of drugs is forbidden during and/or before boarding.
9- The boarding of fire weapons is forbidden.
10- Please control the use of alcohol beverages on board.
